Works of the Nigerian government

Hi. I saw where you created {{PD-NigerianGov}} and I fixed the categories for the template. Then I took a look at the law cited on the template. Section 4 says:

“ Copyright shall be conferred by this section on every work, which is eligible for copyright and is made by or under the direction or control of the Government, a State authority or prescribed international body. ”

Section 9.5 says:

“ Copyright conferred by section 4 of this Act, shall vest initially in the Government on behalf of the Federal Republic of Nigeria, in the State authority on behalf of the State in question, or in the international body in question, as the case may be, and not in the author. ”

Are you certain that works of the government of Nigeria are public domain? From my reading of this, they don't appear to be. --BigDT 03:07, 5 May 2007 (UTC)

Ok ... I took a look at that section. I don't think it's saying that government works are PD, though. It looks like the "second schedule" is their version of fair use. In other words, it is saying that if the government wants to use your work, it is automatically considered fair use.

Section 5 gives the rights that apply to the copyright holder - to publish it, perform it, make derivative works, sublicense it, etc. The second schedule is saying that those rights discussed in section 5 don't occur in this list of cases. In other words, if you write a book, you can't stop someone from making a braille version of it (s), discussing it on the news (n), or used for educational purposes (h). It isn't saying that these acts are public domain, though.

So I'm sorry, but I don't think we can use these things as public domain UNLESS the copyright has expired. Schedule 1 says that photographs expire 50 years after publication and government artistic works other than photographs are PD 70 years after publication. --BigDT 15:07, 5 May 2007 (UTC)
