Disputed non-free use rationale for File:Sderotchilddrawing.jpg

Thank you for uploading File:Sderotchilddrawing.jpg. However, there is a concern that the rationale provided for using this file on Wikipedia may not meet the criteria required by Wikipedia:Non-free content. This can be corrected by going to the file description page and adding or clarifying the reason why the file qualifies under this policy. Adding and completing one of the templates available from Wikipedia:Non-free use rationale guideline is an easy way to ensure that your file is in compliance with Wikipedia policy. Please be aware that a non-free use rationale is not the same as an image copyright tag; descriptions for files used under the non-free content policy require both a copyright tag and a non-free use rationale.

If it is determined that the file does not qualify under the non-free content policy, it might be deleted by an administrator within a few days in accordance with our criteria for speedy deletion. If you have any questions, please ask them at the media copyright questions page. Thank you. Finnusertop (talk | guestbook | contribs) 14:26, 14 December 2015 (UTC)

Photo deleted. Why?

Hello. I am the author af a new article for Bob Nygaard. As there was no photo in Commons, I contacted the subject and he uploaded a photo of himself that he owned. I just got a notice that said you deleted it. Please explain. RVBbU45r_400x400.png, it has been deleted from Commons by Túrelio because: Copyright violation: https://mobile.twitter.com/buncopi. RobP (talk) 11:08, 13 March 2018 (UTC)

Hi @Rp2006:, well, actually you have already all the information in your own post. Anyway, the upload had been checked by a recent-upload patroler on Commons and found to be published earlier on Twitter, which is a default indication for copyvio-suspected upload, and has been tagged for speedy-deletion. Accordingly uploader Buncopi has been notified and the image speedy-deleted. As you may know (or not) on Commons we have thousands of new uploads each day to check. Roughly 5 percent of them are copyvios or have other problems. As anybody can create an account under any name, we have no direct means for verification.
In such cases, the solution is sending a permission to permissions-commons@wikimedia.org (OTRS). As the original upload was done directly, you should ask Mr. Nygaard to send an email to OTRS, just confirming that he has the copyright over the uploaded image File:RVBbU45r 400x400.png and that he has uploaded it by himself to Commons. The content of his mail will not be published and can only be seen by our OTRS volunteers. If you agree to this procedure, I can temporarily undelete the image and tag it with OTRS-pending. When the permission is accepted, an OTRS-volunteer will add an OTRS-ticket to the image-page and the problem will be solved. --Túrelio (talk) 13:21, 13 March 2018 (UTC)
Hey. Thanks. I contacted Nygaard and he will follow through with an email as you specified. So yes, please temporarily undelete it! RobP (talk) 15:58, 13 March 2018 (UTC)
Ok. Done. --Túrelio (talk) 16:13, 13 March 2018 (UTC)
@Rp2006:, as Mr. Nygaard has also uploaded File:Private Investigator Bob Nygaard.jpg, which is also used on Twitter, he should include this second image in his permission to prevent future problems. --Túrelio (talk) 16:20, 13 March 2018 (UTC)
Thanks. I have told Nygaard to do that as well! RobP (talk) 17:01, 13 March 2018 (UTC)

Hi @Túrelio:. Could you please have a look to this report about a vandal on commons? Thank you in advance! 2A02:1778:113:0:0:0:0:29 (talk) 17:00, 19 March 2018 (UTC)

[File:Llanwenarth Court - geograph.org.uk - 1671512.jpg]

Hi, I'm not terribly familiar with the policies on Commons but have a query regarding the above file, which I think you've moved/renamed. The problem is that it isn't Llanwenarth Court, which is another building in Monmouthshire. It is the Church of St Mary and St Michael, at Llanarth Court. I think it would be best if it had its proper name. Thanks and regards. KJP1 (talk) 05:10, 24 June 2018 (UTC)

Hi @KJP1:, actually File:Church of St Mary and St Michael, Llanarth, Monmouthshire -1.jpg had been tagged as duplicate of the other file and I've processed it. The current image has also the description "Llanwenarth Court", which is wrong, if I understand you correctly. So, it's not "Llanwenarth Court", but "The Church of St Mary and St Michael, at Llanarth Court", right? I'll try to correct the filename. --Túrelio (talk) 10:27, 24 June 2018 (UTC)
That's exactly right, as can be seen from the Welsh Government's official historical site, here [1]. Whoever took the photo has captioned it wrongly. That said, Welsh place names can be very confusing! Many thanks for your help. KJP1 (talk) 10:41, 24 June 2018 (UTC)

Hi, why was my own photo removed again for the Virtual Self wiki?

Just trying to figure out what I'm doing wrong. It was removed and replaced the first time and when I went to try and upload it again, it was taken down by you.

How do I prove beyond a reasonable doubt that these are my images?Friendflume (talk) 03:14, 28 July 2018 (UTC)

Hi,
I am currently in holiday, therefore the late reply. It seems you come over from Commons, right? Currently, File:CHARLESKANG-VIRTUALSELF.jpg is proposed for deletion due to missing permission (image was found prepublushed at https://www.instagram.com/p/Bc6KDohhg3t/). But thats not my doing. I had only renamed the image from File:CHARLESKANG-VIRTUALSELFNYC.jpg to File:CHARLESKANG-VIRTUALSELF.jpg. --Túrelio (talk) 13:58, 31 July 2018 (UTC)

Rollback request of photo of missing person Immaculate Basil

Hello @Túrelio:,

Can you please rollback your deletion of Immaculate Basil.jpg from wikimedia commons? I feel this file was deleted incorrectly and without proper notice. You gave the rationale for deleting it as "Fair use is not allowed in wikimedia commons"

Though this image is subject to copyright it is believed to be covered by the U.S. fair use laws because:

  1. the image was released to the media by the family to publicize the search;
  2. the image is low resolution;
  3. it does not limit the copyright owner's rights to the image;
  4. the image subject is missing/presumed dead and a free use version is unlikely to become available;
  5. no free use photograph of the person is available

For a similar case of free use exception on mediawiki file, see: https://en.m.wikipedia.org/wiki/File:Natalee_Holloway_yearbook_photo.jpg#mw-jump-to-license

Thank you NigelFox 23:18, 25 January 2019 (UTC)

Hi @NigelFox:,
just to understand you correctly, you are referring to File:Immaculate Basil.jpg and you are convinced that it is covered by U.S. "fair-use", right? Well, then you need to upload it locally here at :en, per Wikipedia:Non-free content. "Fair-use" material is definitively not allowed on Commons, see c:Commons:Fair use. In case you don't have any longer access to the image-file, I could temporarily undelete it.
By the way, in case you are uploader Nfox24, by adding the template "Non-free web screenshot" you did inadvertently tag the image by yourself for speedy-deletion. --Túrelio (talk) 23:30, 25 January 2019 (UTC)

WikipediaTNT3

Here is the hand https://www.pngkit.com/bigpic/u2e6u2a9y3u2o0w7/ and here is the new TNT https://pixabay.com/vectors/dynamite-explosive-fuze-fuse-bomb-155496/ also can you remove WikipediaTNT & WikipediaTNT2 Afootpluto (talk) 08:14, 18 June 2019 (UTC)

@Afootpluto, thanks. I've deleted the 2 olders versions, as requested. However, the hand holding the burning match might have a problem, as pngkit.com says they don't offer a license (just free for non-commercial use) and the image-page has no way to contact the author directly. So, I looked on Commons for a freely-licensed replacement, but found only "real" images (non-transparent background): File:Burning match.jpg, File:Fireart.jpg, File:Light a match.jpg, File:Burning matchstick 2010.jpg, File:Burning matchstick 2010.jpg, File:Match stick, lit a match, match box, fire.JPG, File:Match directly after ignition.JPG (w/o hand), File:Strike match (4791778263).jpg, File:Mathappu.jpg, File:Burning torches.JPG. --Túrelio (talk) 08:56, 18 June 2019 (UTC)
I have found this one File:Streichholz.JPG, I am in the process of removing the background and changing the flame color. Afootpluto (talk) 13:14, 18 June 2019 (UTC)
I have updated the picture. Is there anything else I need to do? Afootpluto (talk) 13:57, 18 June 2019 (UTC)
No. I've updated the source-entry for the new match image and will later the evening eventually optimize the source-template (just cosmetics). Thanks. --Túrelio (talk) 15:07, 18 June 2019 (UTC)

Hi Túrelio: Some time ago, I uploaded the copyrighted logo of an organization, File:American Federation of School Administrators (logo).PNG, to Wikipedia to be part of the infobox on the article. I just received an automated notice that the image is in danger of being deleted because it's not being used, I checked the article and the file was automatically removed by User:CommonsDelinker, and that edit summary indicated that the image has been deleted from Commons by Túrelio because of a copyright violation. From my non-expert copyright viewpoint this all seems pretty circular: fair use requires the image has to be used in the organization article but the image isn't being used in the organization because of copyright. My inclination is to add the logo back in the article but I want to make sure I'm editing constructively. Was it your intent to trigger this chain reaction when you removed the file from Commons? (If you did, what is the right way to display an organization's logo without running afoul of copytright?) Thanks! - RevelationDirect (talk) 13:59, 28 June 2020 (UTC)

Hi RevelationDirect,
I am not sure to which file you are actually referring. The above linked file sits on :en under fair-use. I am admin on Commons, but not on :en. So, I can't delete any file on :en. However, on Commons none of your uploads has been deleted.
Ok, now, after more research, I see I've deleted File:Afsa-logo-color.png, which had been uploaded to Commons by somebody else. I've deleted it, because the uploader claimed it as own work, but it had been found published on https://www.theschoolleader.org. In addition, the uploader had put it under a CC license, which seemed to be bogus, considering the source from which it had been taken. So, that chain is now clear.
However, there is no relation to your local (:en) upload claimed under fair-use. Fair-use material must not be uploaded to Commons (not allowed) and, per :en policy (resulting from the U.S. copyright law), needs to be in use to be allowed to remain at :en. So, you just need to insert it into the article, for which you had uploaded it. Others will likely check the provided fair-use rationale and eventually you may need to improve it. --Túrelio (talk) 15:09, 28 June 2020 (UTC)
Thank you for your feedback; much appreciated. I re-added the file in the infobox. RevelationDirect (talk)

User:Túrelio. Why has only my image, on the page New England Holocaust Memorial been removed when the same copyright issues will be applied to the other images in the article. I have tried to apply the Commons Non-Free Use criteria. If my photo has to be removed surely you should have removed the others too? Lady Rose MacClare (talk) 20:10, 2 May 2021 (UTC) Student at the University of Exeter editing Wikipedia as part of an Art and Law Module

Hi Lady Rose MacClare,
such question should better be put on Commons, where the image had been uploaded and deleted. Also, I am less often here than on Commons.
Anyway, you are likely refering to File:Holocaust04.jpg. You yourself triggered the deletion by adding "fair-use" templates to the description. Fair-use material cannot be hosted on Commons; it can, howver, be hosted locally here on :en. See Wikipedia:Non-free use rationale guideline. So, you need to re-upload the image in reduced resolution and provide a fair-use rationale. If you don't have the file on your computer or need the description-content, drop me a note on Commons. --Túrelio (talk) 13:50, 4 May 2021 (UTC)

Orphaned non-free image File:PirelliBuildingAfterPlaneCrash.jpg

⚠

Thanks for uploading File:PirelliBuildingAfterPlaneCrash.jpg. The image description page currently specifies that the image is non-free and may only be used on Wikipedia under a claim of fair use. However, the image is currently not used in any articles on Wikipedia. If the image was previously in an article, please go to the article and see why it was removed. You may add it back if you think that that will be useful. However, please note that images for which a replacement could be created are not acceptable for use on Wikipedia (see our policy for non-free media).

Note that any non-free images not used in any articles will be deleted after seven days, as described in section F5 of the criteria for speedy deletion. Thank you. --B-bot (talk) 17:27, 15 June 2021 (UTC)
