Replaceable fair use File:T. A. Barron Author Photo.jpg[edit]

Thanks for uploading File:T. A. Barron Author Photo.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

  1. Go to the file description page and add the text {{di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
  2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).

Hi There - Clearly, I'm new to this. I was given the photo by the subject to put on his wikipedia page. Since he owns the copyright, I thus have permission. So if I reupload the photo, what is the correct way to mark the photo? Thanks! -- Barsouth (talk) 24 May 2018
Hi Barsouth. When the word "permission" is used on Wikipedia (like in the above template), it generally means something like WP:CONSENT. In other words, the copyright holder needs basically to give their advance consent for their work to not only be used on Wikipedia, but to also be downloaded and used by anyone anywhere in the world at anytime for any purpose (including commerical). Such permission cannot also be canceled or revoked after it has been given. All content released under a "free licnese" needs to meet be done in accordance with WP:COPY for Wikipedia to accept it. The file referred to above has already been deleted, so it is no longer visible to me. Deleted files aren't gone for ever; they are only hidden from public view. The file was deleted by an administrator named Explicit and Explicit can still see the file. You can try asking for help at User talk:Explicit if you have any specific questions about the file.
Since I tagged it for deletion per WP:F7 and WP:NFCC#1, I am assuming that it might have been a photo of Barron himself. If it was, then there's really no possible way to accept such a photo as non-free content since non-free images of still living individuals are almost never allowed except in some pretty specific circumstances. If Barron is the copyright holder of the file which was deleted, then he can send an email to Wikimedia OTRS giving his explicit written consent for the file to be released under a free licence accepted by Wikipedia or he can dontate the photo to Wikipedia. Once he does this, an OTRS volunteer will process and verify his email, and then go about getting the file restored if everything seems OK. It's improtant to note the the copyright holder of an image is generally considered to be the person who creates the image, which for a photo would be the photographer and not the subject. So, if Barron is not the copyright holder, he cannot release someone else's work under a free licesne. If the deleted file was of something use, e.g. a painting, book cover, etc., then the permission of the artist, publishing company, etc. is what would be needed.
