History

Ottoman law

Until 1917, the Ottoman Empire Ruled the Land of Israel. Legal Methods in Israel before the Ottoman Empire don't have any trace in Israeli Law.

Israel wasn't an autonomy within the Ottoman Empire, but a province which was an integral part of the empire, which spanned on large areas of Europe, Asia and even Africa. Because of that, there wasn't a separate court system in the land of Israel, and the law that was in the Ottoman Empire was also used in Israel.

The Ottoman law was a comprehensive legal method, with modern characteristics, although it was lacking behind modern legal methods in several ways. The civillian verdicts were setteled by the Mecelle, with an addition of a few other rules set by the Sultan. There were also a Ottoman rules

את הדין המהותי האזרחי הסדיר דבר חקיקה הקרוי המג'לה, בתוספת מספר חוקים שקבע הסולטאן. כמו כן נהוגים היו חוקים עות'מאניים שהסדירו את המשפט הפלילי, דיני הראיות, ההוצאה לפועל, המשפט הדיוני, ושאר התחומים המשפטיים.

בשנת 1984 חוקק חוק לביטול המג'לה[3], אשר ניתק את הקשר בין המשפט הישראלי למשפט העות'מאני.

כיום עדיין נהוגים במשפט הישראלי מספר הסדרים שלידתם בחוק העות'מאני, כגון סיווג הקרקעות. סעיפים 80 ו-81 לפקודת הפרוצדורה האזרחית העות'מאנית שרדו את כל גלגולי החקיקה, ועודם נהוגים במשפט הישראלי כיום[4]. סעיפים אלו עוסקים בשאלות ראייתיות מתחום הדין האזרחי – מעמדה של טענה בעל פה אל מול מסמך בכתב, ואיזה עסקאות יש להוכיח באמצעות מסמך בכתב.
