All I really want to do is leave the article in a state such that a reader is not left with the wrong impression about state works. In other words, so long as this article indicates that the works of some states are Public Domain, that many states waive some or all of their rights under copyright law, or doesn't lead the reader to believe otherwise, we should be good. (There's ample proof that these statements are true; see, e.g. the in-article references, or the ones noted on the talk page, or in {{|tl|PD-FLGov}}.) Let's settle on wording that is acceptable - let's "include something (with appropriate sources) to the effect that many states waive some or all of their rights under copyright law"
