Purpose of use

Used in Harel Skaat article as an example of type of musical arrangement style and type of production which is used by Skaat in many of his recordings– elements which cannot be conveyed in text or images. Specifically, the song sample represents the prominent use of orchestral instruments in much of Skaat's music, and "Milim" is an excellent example of this. The sample's use also is important because this is one of his most well-known songs due to its exposure in the Eurovision 2010 song contest.

Rationale of fair use for Milim sample[edit]

This is a sound sample from a commercial recording. Its inclusion here is claimed to be fair use because:

  • It illustrates an educational article on Harel Skaat, who represented Israel with "Milim" in the Eurovision 2010 Song Contest. It is used in the article to illustrate Skaat's characteristic use of integrating orchestral backing in his ballads, and it is also essential to understanding his stylistic approach towards singing romantic ballads, that is in a strong, emotional manner.
  • It is a sample of no more than 30 seconds of a three minute recording, and could not be used as a substitute for the original commercial recording or to recreate that recording.
  • The sample is of a significant lower quality than the original recording.
  • It is not replaceable with a freely copyrighted sample of comparable educational value.
  • It is believed the sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
  • The audio sample is a copyrighted work and International copyright laws apply to it. If a free or public domain sample is found, it should be used instead of this sample.

I believe that the use of this excerpt is in good faith and its use improves the educational quality of the article on Harel Skaat. Hjquazimoto (talk) 20:47, 25 June 2010 (UTC) Hjquazimoto (talk) 02:25, 27 June 2010 (UTC)
