Rationale of fair use in Gerard Hoffnung[edit]

  1. Source: recording from DECCA Vinyl EP DFE8682 (1960), converted using Audacity.
  2. It illustrates an educational article that specifically discusses the monologue from which this sample was taken; in particular it provides evidence that no wording could possibly replace.
  3. It is a low-quality sample from a much longer recording, and could not be used as a substitute for the original commercial recording; in particular the sample is slightly longer than is normal, but this is necessary to provide a logical extract from the monologue.
  4. It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value
  5. It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording
