Can you help me with licensing?

It's not just you using the image, it's Wikipedia and any people that go to that article. If you're sure the author would be fine with that, then I suggest you write to the image creator and ask them to release it under an appropriate license. See this page for more information. Have him send an email to the OTRS system giving permission. What he said in that email isn't exactly sufficient. He has to release it under a free license, meaning Wikipedia can use it, and anybody that uses Wikipedia can also use it, including for commercial use. See this page for more information. Hi there, i see you have tagged File:Diana Vickers - Songs from the Tainted Cherry Tree.jpg for deletion. I just a quick question/concern regarding the tag.
It states the file is currently not being used, but the file is actually being used in an article but im not sure if it counts or not so i was wondering if you could answer that for me.
The article is Wikipedia:Article Incubator/Songs From The Tainted Cherry Tree, i have used it in this article because i am just starting the article while i am waiting for the undeletion of the article Songs From The Tainted Cherry Tree which is being discussed here : Wikipedia:Deletion review/Log/2010 April 21

It's really up to whoever reviews the file on the day it's due to be deleted whether to keep it a little longer for the article to be created as opposed to being under construction in userspace. In the future, I suggest you hold off on uploading unfree images until the article is created, and use a placeholder image when you're building the article in your userspace. Killing the Future

My photo on the Aftermath page was removed. I assumed I provided the proper copyright/trademark info. I may not only the photographer of the image, but also the manager and record label owner who Aftermath is signed to. --Zoident —Preceding undated comment added 04:21, 7 May 2010 (UTC).

Non-free images need a rationale in addition to source and licensing. But since you are the photographer and the band manager, may I suggest you release a photo of the band under a free license instead? Melesse (talk) 10:25, 7 May 2010 (UTC)

Deletion of "File:Firemans chair knot in use.svg"?

Hello there. I have been unable to locate the discussion/rationale for the deletion of File:Firemans chair knot in use.svg so I'm commenting here. It was a derivative work of the properly licensed PNG version of the same image. The PNG page was properly linked to the (now deleted) SVG version and would have shown up on the "what links here" on the deleted image's page. I don't understand why deleting the derivative image was preferable to updating its licensing info from the original work? Perhaps I am missing something. File:Wielder of Words.jpg no longer an orphan.

Hi, Melesse. The image File:Wielder of Words.jpg was deleted last month, since it was an orphan image. The original article I authored was deleted at the subject's and my request, which left the image orphaned. I would now like to add the image to another article I wrote and recently expanded, Donna J. Stone. As you may notice from the article's discussion page and my talk page, any potential copyright issues with the article have been resolved. The image is of a book of poetry, authored by the late Donna J. Stone and edited by her son, Dr. Christopher Stone, who holds the copyright to the book. In the rationale for using the image in its original article (which was about Dr. Stone), which is no longer on the site but I would think you have access to, I included permission from Dr. Stone to use the image. (The image is widely available anyway.) So could you tell me if and how I can add the image to Ms. Stone's article? Thanks a lot! Mary Ann --Mah Jong (talk) 05:01, 2 May 2010 (UTC)

Since you got permission from the copyright holder, I would suggest you forward that message to the OTRS system so that it's using a free license rather than a fair use one (because fair use pictures of books in authors' articles are typically considered to be replaceable fair use and are subsequently deleted). I'm sure Dr. Stone would send an email to OTRS granting permission to use the image. The book cover image has been published on the internet and elsewhere several times. I can email him about a free license, but I'm not sure he'd agree to that. Fair Use seems to me to be applicable, since the book has been out of print for several years and copies are pretty rare. I'm not a copyright expert or anything, but I'm a literary historian and can safely say that the image is not readily replaceable. As he wrote me regarding his mother's picture (which, of course, is not replaceble since she died and it was apparently the only picture she allowed to be used), that photo has been reproduced hundreds if not thousands of times, before and after Al Gore invented tne internet. :) He freely gives permission, but under Fair Use because, to quote, "I don't want someone drawing a moustache on my mother." I'm sure the book cover image hasn't been reproduced nearly as many times as Ms. Stone's picture, and who draws facial hair on book covers? But I suspect he'll want to stick to Fair Use, which didn't seem to be a problem at the time. So, if Dr. Stone writes a permission email to OTRS, and includes whatever text you think would keep it from getting deleted (short of using a free license), would I be able to post the image on Ms. Stone's article with at least reasonable likelihood that it woudn't be deleted in the future (as long as it's not orphaned again)? Um, Wikipedia doesn't require permission to use fair use images, they just want a good rationale. For the case of a photo of Donna J Stone, that's no problem since she's deceased. In the case of her books, it's trickier. One of the rules of fair use images is that the image will aid in a reader's understanding of the subject, so unless you're referencing the design of the cover or something that really requires a visual aid, that's not the case, and the book cover would just be decorative and therefore not allowed. Oh, I understand. No, the book image is not essential to the article. I just wanted to add it, to make the article more visually complete. But, as you say, I suppose it could be considered decorative -- it's not necessary to the article, so I'll just leave it out. If I end up writing an article about the book itself, then it would be more salient and I'll write you back. Thanks for your patience and information. Replaceable fair use File:DVW_cover.png

As noted in the dispute template I added (and I'm finding this whole communication-solely-by-template thing fairly ridiculous), this makes no sense to me; how is it possible for a free version of a copyrighted book cover to be created? —chaos5023 (talk) 11:04, 5 May 2010 (UTC)

For an article on the book itself, you're correct, it would be irreplaceable and fall under fair use, but only in an article about the book. The book could be adequately discussed in prose in the context of articles about its author and its subject. Melesse (talk) 01:20, 6 May 2010 (UTC)

I guess this is some weird Wikipedia usage of "replaceable" that implies involved value judgments concerning, not whether the media can actually be replaced, but whether it is in some way required by the article, using rotely applied rules. Undelete

Can you kindly undelete File:MyBB_Logo.png which was speedy deleted a while ago? The article MyBB is recreated and the logo file can be undeleted and used under the same fair use rational.

Orphaned file notice on my talk page

Thank you for the notice. Yesterday, I uploaded the picture that will be linked to a new article that has not gone "live" yet. I was reviewing the process for submitting the new article for review prior to having it go "live" last night, and ran out of time. I am submitting the article for review, today. Am I correct in my understanding that, at that point, the picture file will no longer be orphaned? If I run into any problems can I ask you for help? Doc2234 (talk) 19:54, 12 May 2010 (UTC)

That's correct, once the article goes "live" you can remove the notice (or if you forget, a bot will eventually do it). In the future, may I suggest that you hold off on uploading unfree images until the article is created, and use a placeholder image when you're building the article in your userspace. If my proposed article, "Chicanery (album)" is in the backlog too long, could that be a problem from the standpoint of the orphaned file? • The Chicanery (album) article has been reviewed in Articles for Creation. It has been put on Hold with the comment that a band page should exist prior to the album page. The reviewer did not cite any problems with the submitted album article, itself. I have been working on the band article, however, it has been more time consuming than the album article, and I finished the album article first. If the issues concerning the album article cannot be resolved quickly and we go beyond the seven day limit for my file that you flagged as orphaned, could you please help me retrieve it at that point? Life of Riley screen shot

I think I'm going to have to give up on this and any future screen shots. The wikipedia copyright and tags system is a complete maze for anything that is not obvious. I have given what information I can and tried a fair use rationale for what is nothing more than an image of two people but it is insufficient.(Cyberia3 (talk) 11:44, 13 May 2010 (UTC))

Non Replaceable

You tagged one of my images indicating that I indicated it was "non replaceable". I looked at some examples from the Wikipedia:Image use policy page. I'm still confused. I scanned the cover of an out-of-print book. What should I have indicated for "Non Replaceable" in this case? The book is rare and hard to find, but I have one. Thanks for your help. Non-free pictures of books in articles about the author are considered replaceable, unless you're specifically citing the style of the cover or something like that which requires a visual aid. Melesse (talk) 04:53, 15 May 2010 (UTC)

Creating a Category

I just went to look at the proper naming convention for such a category and it would be Category:Jazz albums by British artists. You can click through that link to make a new page and write a short description if you feel that's necessary (most categories related to albums don't have one because the category name itself is descriptive enough) and place it in the appropriate parent categories of Category:Jazz albums by nationality and Category:British albums by genre.
