However, I think that the way it is being used fails the first non-free content criterion. Copyrighted images of living people are not allowed as Fair-use[edit]

Per WP:NFC#UUI, non-free images of living people are largley unacceptable use, as even if a free image cannot currently be found, one can be obtained by requesting or taking a photograph of the living person.
