The Wrong License?

Hi. Thanks for reading. Maybe I'm using the wrong license? Most of the images I'm having problems with (see the contents of this page) are images I personally scanned from free advertising brochures for produces that are directly the subject of discussion of the article I'm using them in. Yes, a scanned image of copyright material is still copyright. For "Fair use" you have to satisfy all ten of the conditions listed at WP:NFCC, but that may be possible in this sort of case. Perhaps I should have left a proper comment along with the boilerplate I posted yesterday.

As already explained in part by JohnCD, the problem is that the images aren't yours to place a free license on in the first place. Rescanning it doesn't change that any more than copying a Beatles tape would grant me ownership of their songs(!)

Obvious commercial material is assumed to be copyrighted, and we'd require clear evidence that the current copyright holder is willing to license it under Wikimedia terms. I'm assuming that's not the case here.

"Fair use" isn't a license per se (since the uploader generally doesn't have the right to license what they don't own). It's a tag and rationale justifying the *limited* use of copyrighted material under US "fair use" laws. Some of your images may be able to be kept for article use with a suitable "fair use" rationale.

However, "fair use" isn't a carte blanche excuse to upload arbitrary amounts of copyrighted material and (for example), I doubt that *all* your scans of the manual will be justifiable as "fair use" within a single article. Unfortunately, Wikipedia and Wikimedia Commons *aren't* the place to upload large amounts of copyrighted material, regardless of whether (e.g.) the original manufacturer is bothered about copies of 30 year old manuals or not.

I notice that you're reducing the resolution of your uploads to "only" 1024 pixels- is this for fair use reasons?

Firstly, this is still high by "fair use" standards. While there is- AFAIK- no absolute limit (and there may be certain cases where 1024 pixel Fair Use is justified), generally speaking, 200 to 400 pixels wide is considered sufficient. Higher resolution images will almost certainly get reduced in size.

More seriously, you still have to tag each image as "fair use" *and* include fair use criteria/rationale explaining why this is justified. You can ask for help with the technical details of filling in the templates, etc., but you should still be able to explain why you think their use is justified.

And, as I mentioned, I personally think including the entire brochure will go beyond the "minimal (necessary) usage" aspect of the policy; as I said, "fair use" isn't meant as an excuse to include arbitrary amounts of copyrighted information, but a justification of using the minimum amount necessary where free material can't be used for that purpose. license and permissions

Hello and thank you for reading.

Some of the images I've uploaded in the last couple of weeks will be deleted and should be because I can't claim any valid license for them. Sorry to waist Wikipedia's time with that.

Other images I believe can be suitably licensed but are already, or about to be, deleted. I made mistakes in the file description page for many of these images but I've tried to correct that.

Meanwhile, the copyright holder of these images, Bruce Forat, has sent a couple of emails to permissions-en@wikimedia.org to provide evidence of permission. But he has received no reply and the images are being deleted.

The advertising brochure that I scanned to produce the images listed above was published by Linn Electronics in 1984. In 1986, they went out of business and Forat Electronics purchased they're remaining assets. http://www.forat.com/history/ Bruce Forat, president of Forat Electronics, believes he owns this brochure and gave me permission to upload scans of the brochure. But the permission email Bruce sent didn't explain his status as the successor and I made mistakes in the file description pages that I think I've corrected.

Bruce will be happy to sent another permission email and better explain the situation. Maybe separate emails for the images with similar provenance would be clearer. But we got no response from the emails we sent four days ago. Maybe the faulty file descriptions was an issue.

Ericmattei, given that both "monotimbral" and "multitimbral" (the parameters for timbrality) link to Timbrality, I think it's fine that the word "timbrality" links to Timbre. Re: Bruce Forat

For sourcing policies and guidelines, check WP:RS (reliable sources) and WP:V (verifiability). Also, Bruce Forat would need to follow WP:BLP (a biography policy). From WP:RS, such things as blogs and discussion boards are generally not considered reliable sources, while magazines, newspapers, trade publications tend to be better for referencing purposes. Try Help:References or WP:Referencing for beginners. In short, it creates a footnote that will be displayed at the bottom of the page, preferably via the {{reflist}} template or something like that. The code should look like this: <ref>Text of the footnote</ref> It's placed in the article proper, immediately after the statement the footnote is relevant to. At that place it will create a small ^[1] that links to the footnote itself at the bottom of the page. The video at WP:Referencing for beginners explains how to easily create nicely-formatted footnotes without bothering with the intricacies of the code. Huon (talk) 19:24, 12 April 2015 (UTC)
