I notice that Themepark has not yet had an opportunity to respond to you yet. In my opinion, this is an appropriate image for uploading to the Commons. It's public domain in Canada, and because it is a pre-1946 Canadian image, it is also public domain in the U.S. (the location of the Wikimedia servers). As long as the copyright status is explained, the source identified (Archives of Ontario), and the {{PD-Canada}} and {{PD-US}} tags used, it shouldn't be a problem.
