More information needed.[edit]

I've added what small amount of information I could find, but since this is the most referenced source of information about Milliam Marbury, I hope someone can add something about his life after the Supreme Court decision that bears his name.Rick Norwood (talk) 14:38, 23 July 2013 (UTC)[reply]

(Not sure how to add my own comment): Marbury's birth date needs confirmation. Sources on the web say either Nov. 7 or Nov. 15. Forte 1996 mentions on page 355 (citing archival documents) that he was born on November 7. This source is cited twice already in the article, so I added it to the date of birth. Woodcutterty (talk) 15:34, 19 November 2015 (UTC)[reply]

Further proceedings?[edit]

The decision of the Supreme Court was that it lacked original jurisdiction. I believe that this means that Marbury could have refiled his suit with a district court. Is that correct? Did he do so?Bill (talk) 05:16, 10 November 2018 (UTC)[reply]

That is correct, and no, none of the petitioners pursued any further action. Susan Low Bloch, 'The Marbury Mystery: Why Did William Marbury Sue in the Supreme Court?', 18 Const. Comment. 607 (2001) argues they would probably have been successful suing in the Circuit Court of the District of Columbia (though it is questionable if Madison would have complied with a writ of mandamus), and speculates that they did not so much care about getting their commissions, but that they were 'simply being good Federalists giving John Marshall the perfect vehicle by which to establish the powers of the Court'.
