Fair use rationale for Image:Jon Lucien.jpg[edit]

Image:Jon Lucien.jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. In addition to the boilerplate fair use template, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use.

Please go to the image description page and edit it to include a fair use rationale. Using one of the templates at Wikipedia:Fair use rationale guideline is an easy way to insure that your image is in compliance with Wikipedia policy, but remember that you must complete the template. Do not simply insert a blank template on an image page.

If there is other fair use media, consider checking that you have specified the fair use rationale on the other images used on this page. Note that any fair use images uploaded after 4 May, 2006, and lacking such an explanation will be deleted one week after they have been uploaded, as described on criteria for speedy deletion. If you have any questions please ask them at the Media copyright questions page. Thank you.

{{helpme}} I have been granted permission by the owner to use this image on Wikipedia. It is readily available in the press kit located at www.jonlucien.com. I would like to know what further rationale must be provided, or how I must proceed. Thank you. Tonymartin (talk) 21:20, 21 December 2007 (UTC)[reply]

First off, you cannot have a "Wikipedia-only" license. It's either public domain, GFDL, Creative Commons, or fair use. If you're having problems with a fair use rationale, remember that a boilerplate template (like {{Non-free logo}}) is not sufficient for fair use; you must write an accompanying fair use rationale. See WP:F for details. NF24(happy holidays!) 21:28, 21 December 2007 (UTC)[reply]

{{helpme}} Thank you for the prompt response. This is not a Wikipedia-only licensing issue. Nowhere is that stated in this instance. Permission is granted by the owner to use this image in articles about the subject. Written permission has been given to me by the owner. The press kit source is verifiable. Must I also include a fair use rationale under such circumstances? Tonymartin (talk) 22:26, 21 December 2007 (UTC)[reply]

Yes. As far as I know, if the copyright holder has not specifically released it into the public domain or licensed it under the GFDL or Creative Commons licenses, then you must write a fair use rationale. NF24(happy holidays!) 01:46, 22 December 2007 (UTC)[reply]
