Fair use rationale for Image:JoePalooka-WinnerTakesAll.jpg[edit]

Image:JoePalooka-WinnerTakesAll.jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. Died in 1992[edit]

I’m surprised that you two (Tewapack & Jkaharper) choose to dismiss my references just because a so called reliable website is unaware of his death. I don’t know if you noticed, but the biographical entry for Joe is more or less identical to his Wikipedia page. So much for putting effort into their site...

First off, we all can agree that his father was an Australian golfer named Joseph Henry Kirkwood and born in 1897, right? If so, then the 1930 US census is for the right family. Let’s have a look at portions of the document:

Joseph H. Kirkwood: Male, 33 years, Australia

Maud L. Kirkwood: Female, 31, Australia

Donald J. Kirkwood: Male, 11, Australia

As you can see, Joe Kirkwood, Sr. has a son named Donald J. Since the 1930 censuses were generally enumerated on April, Donald was to turn 12 later that year. 1930 minus 12 = 1918.

All of this matches with the Social Security Death Index. It’s really not that uncommon for people to have the wrong birth date for whatever reason. Also, his wife’s brother’s 2007 obituary mentions that Joe Jr was already dead at the time.

I understand if you’re golf fans and don’t want to accept this, but the evidence speak for itself. He’s been deceased for more than twenty years. OscarL 00:18, 15 August 2014 (UTC)[reply]

There is no evidence that Donald J. is Joe Jr. You can't use this type of source, see WP:USINGPRIMARY. What you need to find is an obituary for Joe Jr for that date that describes him as a golfer and Joe Palooka of the movies - then you know you've found the correct person. (I've looked for an obituary of the Kirkwood that died in 1992 with no luck yet.) Tewapack (talk) 02:14, 15 August 2014 (UTC)[reply]

Okey, so Donald was his older brother, it seems. Sorry for my confusion...However, with Michael Wayne Woltz' obituary in mind, it is still possible that Joe Kirkwood Jr is deceased. The question is finding out when and where. There is one site that lists him as having died on September 7, 2006, but I don't know where they got the information from.
