Guilty plea on tax charge: confusion over the charge[edit]

At least one media source (New York Daily News) is incorrectly reporting that Koosman pleaded guilty to "tax evasion" or "misdemeanor tax evasion." Under U.S. federal law, there is no such thing as "misdemeanor tax evasion."

Koosman pleaded guilty to one count of willful failure to timely file a federal income tax return, under 26 U.S.C. § 7203, a misdemeanor. The maximum prison time for that would be one year in prison.

Tax evasion is a separate crime, and is indeed a felony. That's 26 U.S.C. § 7201. Maximum prison time for that would be five years.

Unfortunately, it is common for news media, even national news media, to make the mistake of referring to any federal criminal tax crime as "tax evasion." Stay tuned.... Famspear (talk) 21:35, 24 May 2009 (UTC)[reply]
