When creating samples of copyrighted material, if the copyrighted audio is at least two minutes and thirty seconds (2:30) in length, then an appropriate and recommended sample length is one minute (1:00). If the original audio is at least 1:00 in length but not 2:30 in length or longer, then thirty seconds is acceptable (0:30). If the audio is shorter than 1:00, then it should not be sampled. These guidelines should assure that the sample length is short in comparison to the original recording, therefore making it acceptable for fair use.
When creating samples of free or public domain audio, there is not restrictions on length.
All audio samples of copyrighted material should be encoded in Ogg Vorbis, to ensure that the quality of the sample is less than that of the original, and therefore acceptable for fair use purposes.
Ogg Vorbis is the recommended format for all audio files because it is open source.
