I'm missing where precisely the question, concern or problem is. If I'm understanding correctly, you're only talking about the cover art, and not the work itself?
While not explicit, the page now implies that the cover has the same license as the DVD work itself. Since it falls under "non-free" by Wikipedia policy either way, it doesn't seem to matter a great deal whether that's implicit or explicit (because "non-free" is always, by default, implicit in all images anyways, until and unless "free by policy" is made explicit). Neither the DVD nor the cover art can ever hit "free by policy" so long as the NC and ND variables are used on the CC license; those are "non-free by policy".
What does seem to matter is that in all these "non-free by policy" cases is that there's a proper non-free use rationale table filled out per the paperwork gods and that they are all happy with this. In this case, I feel, as an editor, the task has been accomplished: The non-free rationale looks all peachy-keen nifty-fine to me. The image page uses templates {{Non-free image rationale}} and {{Non-free image data}}, which per the documentation seems to work fine if you have both. If I'm reading the docs correctly, you can also use template {{Non-free use rationale}} to replace those two; but I think it would amount to the same thing as you have now.
If the work and its cover art ever do feel like licensing under a free license like the Wikipedia's by-policy "free" WP:CC-BY-SA, I'm sure we'd be happy to fix the image page at that time. In a case like that, we could probably even use some screen shots from the work in the article to help the reader understand better what it is about, and upload all the images to Commons so they could be shared among all Wikimedia projects in all languages. —Aladdin Sane (talk) 16:27, 18 December 2009 (UTC)[reply]
