Fair-Use Rationale

I belive that this qualifies as fair-use for the following reasons:

• It does not infringe upon the rights of Gene McFadden nor John Whitehead.
• It does not infringe upon anyone who is in possession of the rigths to their music.
• The duo was a mainly behind-the-scense group, with few concerts.
• Very few existing mages are available, and virtually none are free.
• New ones cannot be created because both Mcfadden and Whitehead are deceased.
• The website soulwalking.co.uk sevres a similar function to Wikipedia. They appear to be in compliance with UK and US copyright laws, and the picture appears to be a personal photo provided by the duo to promote themselves.
• If there is any objection to the use of this image on Wikipedia, then whoever does own the rights to it may simply say so and request its removal.
