Fair use instead of federal government/FBI work[edit]
Although this photo was released by the FBI in 1994, it appears to be a state driver license photo (for a false identity document).
A Google News Archive search reveals that Bulger was not arrested in 1994 (he fled instead). A search for other mugshots of Bulger finds numerous others, but not this one. Note also the missing identity board that would have the name of the arresting agency, and his name and identification number.
Although this photo was released by the FBI, the creator of the work is likely the state motor vehicle agency that created it.
I believe the use rationale should be pre-emptively changed from federal government/FBI work to fair use (newsworthy, bad resolution, not yet replaceable).
