Summary[edit]

From the album Ecotopia by the band Oregon, this is a sample of the first song, "Twice Around the Sun." The sample demonstrates the Prophet-5 synthesizer used by Ralph Towner, who is heard solo for 10 seconds. He is joined by Paul McCandless on saxophone, with Towner and McCandless tossing the theme back and forth. The rest of the band comes in at 20 seconds, with Glen Moore on acoustic bass and Trilok Gurtu on percussion.

The sample is less than 10 percent of the song's length, as the whole song is 10:26, while this sample is 0:50 0:30.

This sample is greatly reduced quality from the original, using lossy MP3 coding at 160 61~62 kbps.

Fair use rationale for Prophet-5[edit]

This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:

  • It illustrates an educational article that specifically discusses the song from which this sample was taken. The section of music used is discussed in the article in relation to the musical style and the recording process.
  • It is a sample of 50 30 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording or to recreate the original recording.
  • It is of a lower quality than the original recording, at only 160 61~62 kbps MP3 format.
  • It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
  • It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
  • The audio sample is a copyrighted work. U.S. copyright laws apply to this work. Should a free or public domain sample be located, it should be used in place of this audio sample.
