Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. It is a low resolution copy of a video album cover.
2. It does not limit the copyright owner's rights to sell the CD album in any way.
3. For an article about an album, the cover artwork is very important and adds significantly to the article
4. Copies could not be used to make illegal copies of the album artwork on another CD.
5. The image on the cover is significant because it was made by a famous artist, Tenacious D.
6. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
