Fair use rationale[edit]

1. This is a photograph of a deceased individual, for whom no public domain or free use image exists. The photo is thus not replaceable.

2. The image is of a historically significant individual used for non-commercial purposes in association with an article on Friendship Force International, the group founded by him. As such, this use clearly falls under the fair use provisions of American copyright law.

3. The image is of low resolution and is based from a poor digitization of the original newspaper wire photo image.

4. The photographer who took the image is not known.

5. No damage is being done to any potential marketing of the high resolution image owing to the lack of resolution detailed above.

6. The image is important to the narrative of the Friendship Force International article, as the group was conceived of, launched by, and lead by Smith, in conjunction with then President of the States Jimmy Carter. The caption lends evidence to the semi-official connection between these two individuals.

7. The image is being reproduced here in full, without cropping or substantial alteration.
