Its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

1. It illustrates a major modern feature of the Cologne Cathedral. It is not possible to achieve a comparable educational effect without a photo.
2. The resolution is comparably low and the photo is unlikely to reduce the commercial value of the depicted window.
3. It is not replaceable with an uncopyrighted or freely copyrighted image since Gerhard Richter has not responded to a request for a free photo.
