Screen capture of an image taken from the MGM Midnite Movies DVD of Roger Corman's The Pit and the Pendulum. Since MGM holds the DVD rights to this particular film, the copyright for the image is held by them.

This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. It is believed that the use of a limited number of low-resolution screenshots for critical commentary and discussion of the film and its contents on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under the Copyright law of the United States. Fair use rationale for The Pit and the Pendulum (1961 film)[edit]

This image, PitFlash.jpg, is being linked here; although the picture is subject to copyright I (Hal Raglan) feel it is covered by the U.S. fair use laws because:

1. This image illustrates the text next to which it appears, which specifically describes the techniques used to create the film's flashback sequences.
2. The image visually identifies Barbara Steele, one of the film's stars.
3. It is of much lower resolution than the original (copies made from it will be of very inferior quality).
4. It does not limit the copyright owner's rights to market or sell the work in any way.
