Though this image may be subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

1. It is a historically significant photo of a famous individual. It is a photo of Middleton while in command of the 45th Infantry Division, and though several such photos exist, none has explicitly been attributed to a government source or is otherwise available as a free file. The photo is an important enhancement to the article.
2. The photo is only being used for informational purposes.
