Fair use of the photograph under the copyright laws of the U.S., and other jurisdictions where applicable, is asserted for the article 'John Stamos' and the article on the character Tony Gates whom Stamos portrays in the drama series ER for the following reasons:
- The photograph was released by its copyright owner as a promotional photograph.
- An image which does not rely on the doctrine of fair use is very difficult to obtain.
- The image is smaller and of a lower resolution than the original photograph.
