- the image in question is a low-resolution copy of the book cover in question;
- the article in question makes specific mention of the book in question in a critical and explanatory way;
- copies of the image could not be used to make illegal copies of the cover artwork on another book;
- neither the image in question nor its use in any way limit the copyright owner's right to sell the book in question.
