This use of this image on Harold Keke qualifies as fair use for the following reasons:

1) Not replaceable. The subject of the photo is indefinitely detained in a prison for the rest of his natural life. Due to the nature of his career, and the circumstances surrounding his capture, no free image can be reasonably expected to be forthcoming, nor does one currently exist.

2) This image does not infringe on any commercial opportunities. It is at web-resolution, as provided for previewing print requests. The copyright holder has given permission for this item to be used for educational, or informative purposes, and does not hold any extant commercial claim over its use in the context used.

3) The image is minimal. The image is not at full resolution, and illustrates only the subject of the article.

4) The image has been previously published, and released to the public.

5) The image is the primary means of the visual identification of the subject of the article.
