«Флаг Федеральной налоговой службы представляет собой прямоугольное полотнище синего цвета с Государственным флагом Российской Федерации в крыже.

В правой половине полотнища флага располагается эмблема Федеральной налоговой службы высотой три четвёртых ширины полотнища, изображённая в многоцветном варианте.

Отношение ширины флага к его длине — два к трем. Отношение площади крыжа к площади флага — один к четырём».

Геральдический знак — эмблема Федеральной налоговой службы представляет собой изображение двуглавого орла серебристого цвета с поднятыми крыльями, увенчанного двумя малыми коронами и над ними одной большой короной соединёнными лентой; короны и лента серебристого цвета. В лапах орла перекрещённые ключ (в правой лапе) и кадуцей (в левой лапе) золотистого цвета. На груди орла — щит красного цвета. В поле щита изображение всадника серебристого цвета, поражающего копьём дракона чёрного цвета. Высота эмблемы составляет 1,2 её ширины.
