Rationale of fair use for Extraordinary Machine[edit]

The image Image:Fiona Apple and Zach Galifianakis in Not About Love music video.jpg is being linked here; though the picture is originally copyright, I (Extraordinary Machine 02:29, 4 September 2005 (UTC)) feel it is covered by fair use because:

1. The image is a screenshot from a promotional music video originally created by Epic Records, and intended for wide distribution.
2. The screenshot is of lower resolution and quality than the original video (copies made from it will be of inferior quality).
3. No free or public domain images have been located for this album.
4. The screenshot does not limit the copyright owners' rights to distribute the album, single or music video in any way.
5. The screenshot is intended to represent the nature of the album. Its inclusion in the article is important because it illustrates overviews of the album's tracks (including "Not About Love"), most (if not all) of whose lyrics revolve around romantic relationships. It should be noted that the image depicts a woman and man lying in bed beside each other. In other words, this image is the most suitable image to accompany discussions related to the "meaning" of the album and its songs.
6. The screenshot is being used for informational purposes only, and its use is not believed to detract from the original album, single or music video in any way.

This is fair use in the Not about Love article, but not in Fiona Apple, as there is no discussion of the video from which this is taken in the article.
