Summary[edit]

Under German law, photographs (Lichtbilder) are protected by copyright for fifty years after the date of first publication in the case of anonymous works or works of unknown authorship (Urheberrechtgesetz §72). Consequently, copyright on this image may have expired in October 1987.

Additionally, some works of the German government (including works created by the Third Reich), are not copyrighted under Urheberrechtgesetz §5, and are consequently in the public domain. However, this is not extended to images which have been altered, and it could be argued that this image is altered because the original is a photographic negative, whereas the image above is an electronic file.

Purpose of use

To illustrate the most well-known aspect of the article subject. Not only does it illustrate the individuals involved at a specific moment in time, but the ability to see visual expressions gives the viewer an indication of the parties' relationships and inter-personal dynamics.

Replaceable?

No: it is a historically impossible-to-replace illustration of a significant historic event. No free equivalent is likely to come to light. It is of sufficiently low quality that reproduction will not harm the commercial opportunity of the copyright holder.
