Fair use rationale[edit]

Fair use summary for use of the image in the article on A Night Like This (play)

The use of this image in the article A Night Like This (play) qualifies under the "fair use" doctrine because:

  • It is a low resolution copy of publicity photograph for the show.
  • Although most (85%) of the image is used, it is too small to compete with the copyright owner's use of the image;
  • Its use will not deprive the copyright owner of income or the ability to use and exploit the image;
  • It is used for the purpose of identifying and illustrating the farcical production style of A Night Like This in the context of the series of plays known as the "Aldwych farces". This image is the sole visual illustration of that production style in the article; and
  • It cannot be replaced by an equivalent free image; all four people shown are dead.

  • Source: Printed in, and scanned from "The World of the Theatre", Illustrated London News, 22 March 1930, p. 470
  • Description: Image showing typical Aldwych farce production style and the stars Tom Walls (l) and Ralph Lynn (r) with Louis Bradfield (receiving blow to head) and Gordon James (on floor) in a scene from A Night Like This (1930)
