Compliance with Wikipedia's fair use image policy[edit]

I do not believe that a non-free image is available or able to add the same encyclopedic value as this current image does. Following a discussion on an image for Bubbles, it was agreed that this cropped, low-resolution image complied with WP:FAIR. As noted in the discussion, much of Bubbles notability rested on him 'appearing human', by wearing jackets, etc. Thus, only a photograph from the time when Bubbles was in the public eye (1986-1992) would serve such a purpose. Currently, Bubbles is residing at an undisclosed location, making it near impossible for a non-free image to uploaded. Again, even if it was, it wouldn't serve the same purpose or add as much value as the current image does. The current image has been largely cropped and, I believe, complies with Wikipedia's fair use image policy. Pyrrhus16 14:07, 22 May 2009 (UTC)[reply]

Fair use rationale for Bubbles (chimpanzee)
  • It is believed that the use of this image on the English-language Wikipedia to illustrate an article on the person in question falls under the "Non-profit educational" clause of the Fair Use doctrine currently upheld by United States law. (17 U.S.C. § 107)
  • The image is irreplaceable; a free analogue is impossible to produce as the original will be covered by copyright for the foreseeable future.
  • Owing to the limited web-resolution of the image, only a small portion of a copyrighted work is used.
  • For the same reasons, the portion of the copyrighted work used is of inherently lower quality than the original, reducing the risk of competitiveness and therefore the effects of this copy on the market for or value of versions held by the owner of the copyright.
  • The image is being used in an informative way and should not detract from the original work, nor does it imply endorsement of the article in question by the subject.
  • The image is significant since it serves to provide primary illustration of the subject of commentary, (Bubbles)
If you expand the current rationale to explain in further detail why the image is irreplaceable (as in, why someone could not take a free image of this still-living ape) then you are welcome to remove the deletion notice. J Milburn (talk) 21:59, 22 May 2009 (UTC)[reply]
