The frame (or the image) is from the actual animated logo, which is non-free. A duplication of the exact image and color gradation of each letter in the image would be difficult, if not improbable, and therefore not convey the feeling of authenticity desired by any comparable image-representative of the article content's meaning. In other words, it is not replaceable with a non-copyrighted image of comparable meaning, and is therefore declared as fair use. |

Other information | CBS has not used the image since the late 1960's, when color broadcasts did finally become the norm on American television. Use of this image could serve as a reminder of that idea, and thus it is argued that use of the file here will not be in any way that will harm the owner (CBS) commercially. |
