The manner of said use constitutes a "fair use" under United States copyright law. Specifically:

1. The article for which the use occurs is purely educational in nature.
2. The sole purpose of this use is to illustrate the CD in question.
3. Said image is the primary means of visual identification of the main topic of the article.
4. It is a low-resolution image, and thus not suitable for the illegal production of counterfeit goods.
5. Since it is copyrighted CD keep case box art, the image is not replaceable with a free content image.
